The Associate General Counsel – Privacy and Data Protection, reports to the Chief Privacy Officer/Deputy General Counsel for UnitedHealthcare and provides legal counsel and privacy- by-design consultation on domestic and international consumer privacy issues with a focus on health information privacy. This is a high visibility position in fast passed environment.
Primary Responsibilities:
Provide expert counsel on HIPAA Privacy, Security and Marketing Rule considerations in health care
Partner with Information Security, Sourcing and Vendor Management operations
Perform/oversee legal and factual research to provide informed legal advice (e.g., regulatory/statutory, case law, contractual
Provide legal advice/advocacy to support the client's business goals and ensure that the company's interests are protected at all times (e.g., proposed contracts/relationships/products/legislation/regulations)
Provide legal guidance to support compliance efforts, in collaboration with Compliance and Regulatory Affairs
Assess and communicate privacy and data protection legal risk, and assist the business in objectively assessing/balancing legal risk and business risk
Participate in and lead or oversee investigations in privileged settings, advise clients on privileged matters and provide counsel regarding maintaining privilege
Draft and implement policies and procedures for use by the Privacy Office and/or business segments
Collaborate with applicable business partners to drive coordination within functional areas and/or across the business lines (e.g., facilitate multi-faceted responses)
Required Qualifications:
Requires a Juris Doctorate degree
5+ years of legal experience in a corporate and/or law firm setting
5+ years in working in Privacy, health law, IT Security or a related field with transferrable skills
Proficiency with Microsoft Office skills (Excel, Word, PowerPoint, etc.)
Preferred Qualifications:
Privacy and or IT Security Certifications (CIPP, CRISC, CISSP, etc.)
Familiarity with data security standards and frameworks (NIST, FISMA, HIPAA and etc.)
Strong understanding of the healthcare and public health sector, especially in health insurance and/or the managed care industry
Knowledge of U.S. health care and regulatory law
Experience with regulatory agencies and administrative experience with state insurance regulations
Understanding of health care benefit coverage and medical policy development
Proven success in collaborating across a complex, matrixed business environment
Demonstrated understanding of business problems related to assigned legal projects
Well-developed written and verbal communications skills
Excellent verbal presentation skills, live and via WebEx
Ability to evaluate and determine appropriate legal course of action to meet business needs
Ability to build and maintain rapport with superiors, peers, subordinates, and external company contacts
Strong collaboration, communication and research and writing skills
